LIABILITY WAIVER AND RELEASE <\/strong><\/p>\n\n\n\n

I, (The “Participant”), In consideration for my participation in Activities associated with <\/em>Megarealm VR (“Megarealm VR”) with an address at: <\/em>125-5660 cedar bridge way, Richmond, B.C., Canada, and if such Participant is a minor, the Participant’s parent and\/or legal guardian, (collectively with Participant, “Releasors”), hereby agree and acknowledge the following:<\/em><\/p>\n\n\n\n

I consent to waive certain legal rights, including the right to sue the Megarealm VR and, if applicable, its owners, agents, representatives, and affiliates from any loss, injuries, or damages that may happen to me during my participation in any and all virtual gaming Activities associated with Megarealm VR (the <\/em>“Activities<\/em><\/strong>“).\u00a0<\/em><\/p>\n\n\n\n

  1. I understand and am aware that my participation in the Activities involves tangible or intangible harms, which include but are not limited to physical and psychological injuries which may lead to illness, tiredness or soreness in muscles, joints, or other body parts, hearing loss, paralysis, spikes in blood pressure, panic attacks, anxiety, PTSD, fainting, emotional distress, economic loss, death and other adverse effects.<\/em><\/li>\n\n\n\n
  2. I agree that the above-stated losses may result not only from my actions but also from others’ actions. With the knowledge and understanding of the stated risks, I chose my own will and volition to continue participating in the Activities.<\/em><\/li>\n\n\n\n
  3. I also acknowledge and am aware that there are various risks that I may not have determined, yet I waive my right to any and all claims that may result from these undetermined and unconsidered risks, and I choose of my own will and decision, to participate in the Activities. <\/em><\/li>\n<\/ol>\n\n\n\n

    5. It is my liability to consult a physician prior to participating in Activities, and I confirm that I am medically fit to have no medical conditions that would prohibit me from participating in any of the Activities. I will not participate in Activities under the influence of alcohol or drugs.<\/em><\/p>\n\n\n\n

    6. By entering <\/em>Megarealm VR’s location or premises, I authorize Megarealm VR to use the following personal information:<\/p>\n\n\n\n

    \u00b7 My picture \u2013 including photographic, motion picture, and electronic (video) images.<\/em><\/p>\n\n\n\n

    \u00b7 My voice \u2013 including sound and video recordings.<\/em><\/p>\n\n\n\n

    7. By providing your email address and phone number, you consent to receive marketing communications from Megarealm VR. These communications may include promotional offers, newsletters, product updates, and other marketing materials.<\/em><\/p>\n\n\n\n

    8. I hereby grant Megarealm VR, its subsidiaries, successors, and assignees the right to use, reproduce, publish, market and advertise for all purposes, my name, pictures of me in film or electronic (video) from, sound and video recordings of my voice, and printed and electronic copy of the information as described above in any and all media. This permission extends to all languages, media, formats and markets now known or hereinafter devised. This permission shall continue forever, and I will not demand or claim any sum in connection thereof.\u00a0<\/em><\/p>\n\n\n\n

    Covenant Not To Sue. <\/em><\/strong>I will not initiate any lawsuit or other court action against Megarealm VR, nor will I join any such proceeding, including any claim for monetary damages. I admit and agree that I am entering a covenant not to sue Megarealm VR in any ability, including to hold Megarealm VR liable for any injury, losses, or damage sustained by me or my property, even if it is because of Megarealm VR’s negligence or omission. I also relinquish the right of any of my insurers to demand any such claim.\u00a0<\/em><\/p>\n\n\n\n

    Indemnification. <\/em><\/strong>I hereby agree to waive any and all legal claims against the Megarealm VR and indemnify the Megarealm VR and its affiliates, (if applicable) directors, officers, subsidiaries, employees, agents, successors, assigns, and sponsors and hold them harmless against any and all damages, losses, injury whether tangible or intangible, legal claims, and demands, including reasonable attorney’s fees, which may arise from or relate to my participation in Activities or my conduct or actions.\u00a0<\/em><\/p>\n\n\n\n

    Enforceability.<\/em><\/strong> This Liability waiver will bind and be enforceable against me and all of my representatives. I agree that this Liability waiver should be imposed to the fullest extent of the law, and if any part thereof is held invalid, the remainder should continue in full legal force and effect. <\/em><\/p>\n\n\n\n

    Governing Law.<\/em><\/strong> This Liability Waiver shall be construed and interpreted in accordance with the laws of Canada.<\/em><\/p>\n\n\n\n

    Execution.<\/em><\/strong> I have read this Liability waiver and agree that by signing this, I forfeit any right, claim, or ability to hold the Megarealm VR responsible for any losses related to the Activities which may occur before, during, and after participating in the Activities associated with Megarealm VR.<\/em><\/p>\n\n\n\n
